El Paso, TX (KDBC) — Larry Otero, the man listed in police reports as the driver of the 2004 Mercedes that entered I-10 going the wrong way killing 29-year-old Gabriel Morales last month was set to appear in court Monday morning in a separate DWI case. However, Otero never arrived for his court date.
Otero has not been charged by EPPD in the accident that took Morales' life, and toxicology reports are still pending in the case.
Representatives at both Del Sol and University Medical Center say that Otero is not currently a patient in either facility.
Otero had previously been arrested for DWI in 2004; the case was eventually dismissed in 2006. Otero was then arrested May 25, 2013 for DWI with a BAC >.15.
Monday, Otero was set to be arraigned in court for the May arrest. Following Otero’s failure to appear in court Monday morning, Judge Julie Gonzalez filed a charge for failure to appear.
We were the only media outlet in the court this morning, as Otero failed to appear. The county court at law says that when a defendant fails to appear at a court date, the court issues a charge for failure to appear. A county attorney will then prepare the warrant and return it to the judge to sign. After the warrant is issued, law enforcement will attempt to make an arrest.
As of late Monday afternoon, the warrant had not been officially filed. We will continue to follow this story as more information becomes available.
