El Paso, TX (KDBC) — El Paso County will not face an injunction over same-sex partner benefits, a judge decided Tuesday.
Earlier this spring, Texas Attorney General Greg Abbott ruled that local governments cannot extend benefits to same sex couples.
Carl Starr, a self-proclaimed constitutionalist, then filed a suit against the county.
He also requested an injunction until the lawsuit is decided, but Tuesday a judge denied that request.
However, the lawsuit continues.
"We are tweaking the policy so that we can offer essentially the same benefits but with just using a little bit different language. We should get that new policy back in the next couple of weeks," said County Judge Veronica Escobar.
Once that policy is approved, Escobar says the county will ask the judge to dismiss the lawsuit.
