Las Cruces — A Las Cruces area senator has been fined $1,200 by the New Mexico Secretary of State for allegedly misusing campaign money. The state found 12 instances in which incumbent Mary Jane Garcia allegedly reported campaign expenditures as cash payments to herself between January 2010 and August of this year. The state says it appears Garcia also violated the campaign reporting act by making checks payable to cash. The law states any payments not made from a petty cash fund must be written to the person directly. Garcia has 10 days to give the state a written explanation as to why the violations occurred. If there is no evidence of wrongdoing the fines will be waived.
