El Paso — It was a packed courtroom as both legal teams met in Friday's charge conference in Yara Perez's retrial. Perez is accused of murdering her 3-year-old daughter Jacqueline Gonzalez in 2007. Perez is facing 2 counts of capital murder. Both the Defense and the Prosecuting attorneys asked for changes to the charges.
After about an hour, court reconvened as both sides reiterated their message to the jury. Prosecutors want the jury to find Yara Perez guilty on the basis that she failed to protect Jacqueline Gonzalez. The defense argues Perez was suffering from "Battered Wife Syndrome" and that the defendant's boyfriend, Francisco Castaneda, is the person who actually murdered the 3-year-old.
The jury is expected to deliver a decision later this afternoon.
