Socorro in violation of state constitution

A decision made by city officials in Socorro is in violation of the state's constitution. That's according to Texas Attorney General Greg Abbott, who issued an opinion today on the city's recent decision to extend council terms to four years. the opinion from the AG states cities must hold a charter amendment election to change term lengths to longer than two years. In 2008, Socorro did pass a charter amendment that extended terms to three years, but not four. Socorro city spokesperson Dave Garcia disagrees with the opinion. He says it contradicts state law which allows cities to move to four year terms. He says the city is "flummoxed" by the decision.

State senator Jose Rodríguez released this statement regarding the Texas Attorney General's opinion: "Yet another opinion stating the obvious: Socorro city council violated the law when they gave themselves longer terms without consulting voters."
