Marmolejo Statements Suppressed

Some statements taken from accused murderer David Marmolejo will not be used in his trial.

Today a judge decided that cell phone records from the night Marmolejo's mother was killed can be used. A taped statement taken the day Marmolejo was arrested has been thrown out because Marmolejo was never read his rights, but witnesses call still be questioned about what he said. Lawyers can also talk about the statement as long as the direct transcripts aren't made and it's never played for the jury.

Marmolejo is accused of strangling his mother, Gloria to death last summer, then throwing her body in the desert in Santa Teresa, NM.

Another hearing to decide if his murder trial will be held in El Paso is set for next week.
