LAS CRUCES, N.M. — The Dona Ana man accused of allegedly beating his 5-month-old daughter remains in custody.
Jerry Marquez, 24, is facing four counts of intentional child abuse resulting in great bodily harm.
Las Cruces Police said they responded to a home where the 5-month-old girl was having trouble breathing last Friday.
According to a criminal complaint, first responders told police the girl appeared to have a head injury.
Marquez told investigators the 5-month-old had vomitted and he allegedly pulled her while trying to help her breathe causing her to hit head on the floor.
The court documents said police were later called out to the same house for a possible suicide.
The records show a woman found Marquez hanging from a rope and kneeling on a stool with a chain around his neck.
The criminal complaint alleges the woman removed the chain and Marquez began crying saying he didn't mean to do it.
According to the documents Marquez later admitted to shaking the baby once out of frustration and admitted to banging the girl's head on the frame of the couch.
The documents also say he admitted to smoking marijuana twice a day while taking care of his daughter.
Marquez remains in custody at the Dona Ana County Detention Center.
