The El Paso Police Department arrested the man they say is responsible for the death of 13-year-old Pablo Hernandez early Monday morning after he was released from the hospital.

Julian Tapia, 32, from San Elizario was allegedly driving while intoxicated when he smashed his Ford F-150 truck into the back of a Chevrolet Suburban driven by 40-year-old Patricia Hernandez. Hernandez' two teenage children, Isabel, 15, and Pablo, 13, were passengers in the Suburban.

Pablo Hernandez, a student at Ricardo Estrada Jr. High, was pronounced dead at the hospital a short time later. Isabel, a student at Horizon High School, is still listed in critical condition at Del Sol Hospital.

Tapia was receiving treatment at Del Sol following the crash, however, upon his release early Monday morning, El Paso Police placed him under arrest and charged him with Intoxication Manslaughter.

Tapia was booked into the El Paso County Detention Facility with a bond set at $100,0000. Police say that the investigation remains open and additional charges may still be charged against Tapia.
