Las Cruces couple suspected of leaving 2-year-old in car

A Las Cruces couple found themselves behind bars after they allegedly left their 2-year-old daughter alone in a car while they went inside a local restaurant to celebrate a birthday.

Yacxubelli Grado-Garcia, 22, and Ramiro Hernandez, 29 have each been charged with one count of negligent child abuse following the incident.

LCPD were called to an area restaurant just before 1:00 a.m. Thursday morning where a restaurant employee reported seeing a 2-year-old girl inside a car seat in the back of a Chevrolet Silverado that was parked inside the parking lot.

Detectives on the scene learned that Grado-Garcia and Hernandez went to the restaurant to celebrate Grado-Garcia's birthday. The couple went inside just before midnight and ordered two 23-ounce mugs of beer and an appetizer. The couple then reportedly ordered two more beers approximately 20-minutes later.

The restaurant was able to provide investigators with a receipt proving that the couple had been inside for more than 50 minutes.

When asked, the couple indicated to investigators that the little girl was asleep when they arrived at the restaurant and they didn't want to wake her up, so they left her buckled into her car seat in the truck while they went inside to eat.

Grado-Garcia and Hernandez were both booked into the Dona Ana County Detention Center with bonds set at $10,000 each. Relatives of Hernandez' were able to take custody of the little girl who showed no signs of injury.
