Judge rules Eastside bar will stay at Hawkins Plaza

An embattled Eastside bar will remain open for business, after a federal judge ruled in favor of the 3-Legged Monkey and owner Mike Armstrong earlier Friday.

As NewsChannel 9 reported, the City of El Paso planned to purchase the Hawkins plaza where the 3-Legged Monkey resides. Details in the sale indicated an eviction for "undesirable tenants"; tenants like the 3-Legged Monkey

It's just another battle the bar has overcome in its years of being open at the Hawkins Plaza.

The Texas Alcoholic Beverage Commission has tried to get the bar's permit taken away twice.

The first time, after Lourdes Lopez died in June 2009. She had just left the bar when she slammed head-on into another vehicle in Horizon City. Reports showed she had a blood alcohol level more than twice the legal limit.

The TABC, instead of revoking its permit, allowed the bar to continue under more restrictions.

Then the TABC tried to revoke 3-Legged Monkey's permit, citing it was often over-capacity, as well as the murder of a Fort Bliss soldier in the summer of 2011,

A judge ruled there wasn't enough evidence to show the bar was responsible for overserving, which the TABC said led to the murder.

Owner Mike Armstrong says he's relieved at the judge's decision Friday, and looks forward to moving on.
