El Paso — A former Border Patrol agent has been sentenced to 51 months in prison on Thursday for smuggling arms into Mexico.
28-year old Ricardo Montalvo's lawyer recommended the 4-year and 3-month sentence to Federal Judge David Bruines Thursday morning. Judge Briones agreed.
The former Border Patrol agent also admitted to a dependency on alcohol. The judge recommended he seek a comprehensive treatment for his addiction.
Montalvo has pleaded guilty to one of the counts in August and has been in fderal custody since April of 2012. Accordingto the indictment, Montalvo bought ammunition and firearms similar to the ones drug cartels use. As part of his sentencing, he must surrender all of his weapons and ammunition which includes rifles, pistols, and federal ammunition.
His girlfriend, Carla Gonzales-Ortiz, was also arrested in April and was sentenced earlier this month for not reporting the smuggling scheme to Federal Officials. She is serving a year of supervised release - a type of probation.
In court, Montalvo apologized to his family and promised to never commit these types of crimres again and said, "I hurt the people I love... and I'm going to better myself."
As part of his sentencing he will serve 3 years of federal probation and he was also fined $100.
