El Paso, Texas (KDBC) — Former El Paso County Judge Anthony Cobos is facing fraud charges in Dona Ana County. It was an unexpected arrest for Cobos as the arrest comes just weeks before his scheduled surrender to a federal prison in Colorado.
On Friday morning, Cobos was arrested in his home in the Upper Valley and was later transported to the Dona Ana County Detention center in Las Cruces. Cobos is accused of defrauding a couple in Chaparral by selling a mobile home that already had a foreclosure by the mortgage holder.
The investigation determined that Cobos was never the legal holder of the property which reportedly belonged to his stepmother who is now deceased. This couple allegedly payed the former judge a little over $500.00 dollars each month since 2009. Those payments totaled to more than $43,000.
The former county judge is also scheduled to surrender on February 11th to federal authorities in Colorado after pleading guilty of corruption charges when he was county judge. Dona Ana County Sheriff’s spokesperson said it will be up to a judge if Cobos is released before his surrender date.
“It was important to us that we get these charges filed prior to that he’s going to be arraigned on Monday he’s currently at the Dona Ana County Detention Center where he is being held on a 50 thousand dollar cash only bond, he will have an opportunity to make that bond after his arraignment on Monday morning but if he can not the he cannot turn himself in Colorado.” Sheriff's Spokesperson Kelly Jameson said.
Sheriff investigators obtained receipts of each payment made to Cobos from the couple. Jameson added that if Cobos pays his bond it would be Dona Ana County’s responsibility to transport him once the prosecution process begins.
