DA: No-Refusal DWI Policy Would Eliminate Loophole

EL PASO — El Paso moved forward in adopting a no-refusal DWI policy.

Mothers Against Drunk Driving, law enforcement and the district attorney's office were working to implement the policy.

No-refusal means that if a person suspected of drinking and driving is unwilling to provide a breath specimen, a warrant can be issued to draw their blood.

The DA's office said with the policy, there would be no loop hole in trying to get out of a DWI.

"We are hoping that if people understand, the drivers understand that law enforcement will get the blood alcohol concentration either from breath or blood one way or the other that they will strongly think twice or reconsider before they drink and drive,"Assistant District Attorney Denise Butterworth said.

If the initiative is adopted this fall, all law enforcement officers would be able to get everything in one location downtown, including a search warrant signed from the judge and the blood sample from a nurse.
