A hearing is set for David Marmolejo Tuesday. The hearing will determine which city his trial will be held in. Lawyers argue that this case has gotten too much publicity in El Paso, so a fair jury cannot be found.
Marmolejo is set to go on trial latter this month. He's charged with murder. Prosecutors say he strangled his mother Gloria to death last summer, then dumped her body in the desert.
Other pre-trial hearings have determined that evidence, like cell phone records from the night Gloria was murdered, will be allowed.
